ReplyDeleteActually, it is a crime. Theftin general is defined as the taking or criminal conversion of anything, animate or inanimate through fraudulent means, and without color of right. If you really want to split hairs you can simply claim that he committed fraud, but this nevertheless results in the classification of theft by deception which still falls within the realm of theft. When you say that it wasn't a crime, you are basing this on your notion of theft as "stealing" or what is codified in many states as Larceny, which is the trespassory taking of a chattel. However, according to the common law, theft is still an offence, even in states that maintain Larceny as the primary offence.

It really isn't THAT impressive. As the employee / manager said, he's not supposed to do that without a receipt. This is more a case of foolish McDonalds employee and less a case of good social engineering. You can't go to any McDonalds and do this, apparently just this one is easy to fool.

I think the real question here is whether or not it's worth it to scheme to get about $3 dollars worth of food. I guess if I was really that desperate maybe. Just think about how much time it took him and how many times he actually had to repeat his story. I could find $3.00 in change in my couch faster than that...
On the legal question, it's less of legality than of morality. I mean, do you honestly think that McDonalds is going to drag him into court over $3.00 worth of food? They would be wasting more time (time = money) than it would be worth.
Yes, it is wrong. There's no denying that. However, have you ever lied to someone? That's just as bad.
Overall, I think we have all learned a very valuable lesson in how to inflate our egos. Kudos to the two young men in the video for exposing just how compromised the McDonalds security force is. Thank you to all the other people who felt it necessary to use profanity in their posts, because sometimes a cultured vocabulary just doesn't cut it.
On a serious note thank you to the people who posted comments that made sense and followed the principles of logical discussion.
It's the manager (at least that's who I'm assuming it was) that should get in trouble, if anyone at all.
ReplyDeleteLike he said, it's a general rule to not replace a customer's food if they don't have a receipt. Unfortunately, as seen in the movie, the common attitude towards people who pull this sort of thing is "I really don't care right now. I'll give you the food you want, as long as you get the hell out of my face."
A better way to get free food from McDonalds (or any other fast food place, really) is to find a receipt on the ground somewhere, then take it in, and say you didn't get something that was on it. You have a receipt, so for all the employees know, you did order that food, and you just want to get what they didn't give you the first time.
You'd just have to check the time and date on the receipt, because if you were to pull such a stunt, they'd be sure to ask you when it was that you came in.
Fraud is a crime but even in this case you will never find a judge who will convict you. I work at an applebees and i see things all the time where someone comes in without money and orders food. Then they make sure they complain about everything, recooking a steak 5 times for one guest even. They eventually get it free. there is no proof in these situations which also makes it hard to prosocute.

Fries get thrown out after seven minutes, sometimes an extra burger gets made and just sits there. So what if a corporate giant gets cheated out of five bucks? I still get paid.

ReplyDeleteWell it SHOULD work in every McDonald's. I've been a manager in a McDonald's store (as written on their equipment) and I followed the one week SMC (Shift Management Course). They told us that such scams represent only 2% of our complaints. So they better give food to the 2% scammers than unsatisfying 98% of their already unsatified clients.. Whenever you go at McDonald's, remember one thing: Total Satisfaction of the Client. And you're the client. And if the restaurant doesn't "satisfy" you, there's a whole lot of people higher who just want to make you believe they care about you when in fact they just don't want you to speak bad about them.

There are plenty of crimes associated with every single product you buy/use. Really do you think your made in Mexico jeans are crime free? Instead of stealing from a corporation you choose to steal from hard working people. ReplyDeleteIn the retail business it is known as the " perfect crime". Customer calls a day after they buy a bunch of stuff and say they are missing a shirt or whatever from the bag. The cashier must have forgot to bag the item. Depending on the sincerity and/or acting ability of the customer we will give them their so called "missing item". This scam (like the McDonalds one) probably works a bit better if your older. Most fast food places will not just give free food to a teen kid. One scam I did learn from a reformed shoplifter regarding free food seemed too good to be true. This guy would call up a chain style restaurant ( he said chain because they are much easier targets) and say he had a problem with a take out order from like two weeks ago. He would ask to speak to a manager and claim he called and left his phone number and name but nobody ever called back. At this point most managers are apologetic and willing to replace the food he never got in the first place. This guy basically did this twice a year to the same restaurant so they would not catch on. He did say however that the turnover was so great at fast food places he could scam them on a monthly basis. Free food scams are wrong but if the manager just gives you the food without proper ID or investigation then shame on them as well. I do agree that this probably only happens 2% of the time to businesses and so they just give in instead of wasting time looking into it.
